Application
- These Terms and Conditions apply to all purchases of services and goods made by you (the “Customer” or “you”) from us, niku-naku Ltd, a company registered in England and Wales under number 16090990. Our registered office is at Smugglers Cove Boatyard, Frongoch, Aberdovey, Gwynedd, Wales, LL35 0RG. - These terms govern your purchase of all services we offer. By placing an order, you confirm that you agree to be bound by these Terms and Conditions. You must be at least 18 years old and legally capable of entering into a contract to purchase our services.

- Consumer: An individual buying primarily for personal use, not for trade or business purposes.
- Contract: The legally binding agreement between you and us for supplying the services.
- Delivery Location: The place where the services will be provided, typically our premises or another location agreed in your order.

Services

- If you order services tailored to your specific requirements, you are responsible for ensuring all information you provide is accurate.
- All services are subject to availability.
- We may update or modify services as needed to comply with legal or safety requirements and will notify you of any changes.
Customer Responsibilities
- You must cooperate fully with us and provide all necessary information and consents for us to deliver the services.
- Before attending any sauna session, customers must agree to sign our waiver form and read our customer briefing.
- Customers under 16 must be accompanied by an adult.
- If you fail to meet these obligations, we may suspend or terminate the contract immediately after written notice.
Personal Information
We handle your data according to our Privacy Policy. By providing your contact details, you agree to receive communication from us via email or other electronic means.
Basis of Sale
- Descriptions on our website do not constitute an offer to sell until we accept your order.
- We may reject orders for any reason but will try to inform you promptly.
- The online ordering process allows you to review and correct your order before submission, and you are responsible for accuracy.
- A legally binding contract forms only when you receive an Order Confirmation email from us. Please check this confirmation carefully and notify us of any errors immediately.
- No contract changes are valid unless agreed in writing by both parties.
- If you are not purchasing as a consumer (e.g., as a business), please inform us to receive terms suited to your situation.
Fees and Payment
- Fees and charges are as listed on the Website at the time we accept your order and include VAT at the applicable rate.
- Payment must be made by credit or debit card at the time of booking, and we may take payment immediately or prior to service delivery.
Delivery
- Services will be delivered at the agreed sauna location and time.
- If we fail to deliver on time (regardless of circumstances), you may request a reduction of fees or a refund, up to the full amount paid.
Withdrawal and Cancellation
- You may withdraw your order before the contract is formed without penalty or reason.
- Cancelling your sauna session:
- More than 48 hours’ notice: Refund minus a handling fee (£1 per communal spot, £2 per private session), or receive a full-value voucher or reschedule.
- Less than 48 hours’ notice: No refund available.
- Rescheduling your sauna session:
- More than 48 hours’ notice: Free rescheduling.
- Less than 48 hours’ notice (within the same week): We will try to reschedule at no extra cost, subject to availability.
- To cancel or reschedule, email sauna@niku-naku.com with your booking details (full name, email, date/time) and your preferred option.
- If we cancel due to unforeseen circumstances (e.g., bad weather), you will receive a full refund or the option of a voucher.
Gift Card Terms
Refunds on gift card purchases incur a £2 handling fee and are only available before the card’s start date.
Conformity
- We will provide services with reasonable care and skill.
- Any information or promises made to you about the services are part of the contract if you relied on them when deciding to purchase.
Duration, Termination, and Suspension
- The contract lasts until services are fully delivered.
- Either party may terminate or suspend the contract with written notice if:
- There is a serious breach of contract that is not remedied within 30 days after notice; or
- Bankruptcy or liquidation proceedings commence against the other party.
- Termination does not affect any rights or liabilities accrued before termination.

- Your privacy is important to us. We comply with the UK General Data Protection Regulation (GDPR) and related data protection laws.

Governing Law, Jurisdiction, and Complaints
- These Terms and Conditions, including any non-contractual matters, are governed by the laws of England and Wales.
- Disputes may be resolved in courts in England and Wales or, if you live in Scotland or Northern Ireland, in their respective courts.
- If you have a complaint, please contact us first. We aim to resolve all issues fairly and will respond within 10 working days.
